These terms apply to the TheTourKo website, web app, Chrome recorder extension and the demos it serves (together, the "Service"), provided by TheTourKo ("we", "us"). By creating an account or using the Service you agree to them. If you use the Service for an organization, you confirm you may accept these terms for it, and "you" means that organization.
1. Accounts
- You must be at least 18 years old and give accurate details. One person per login.
- Keep your password safe and turn on two-step sign-in where you can. You are responsible for what happens under your account; tell us at once if you think it was misused.
- Workspace and organization owners decide who joins and what role they have, and are responsible for their members.
2. Your content
- "Your content" is what you or your members record, upload or write: screens captured by the recorder, captions, voice, media, and the leads and analytics your demos collect.
- You keep all rights to it. You give us a limited licence to host, copy, process, transmit and display it only to run the Service for you, including sending it to the providers that power features you use (see the Privacy policy).
- You are responsible for having the right to record and share it. Before you share a demo, check it does not expose passwords, keys, personal data or confidential information you are not allowed to share; use redaction.
- When your demos collect leads, you decide what to ask for and you are responsible for the notice and consent those viewers need. For that data we act on your instructions (as your data processor).
3. Acceptable use
You agree to follow our Acceptable use policy. We may remove content or suspend access that breaks it, and will tell you why unless the law or safety prevents it.
4. Plans, payment and taxes
- The Free plan costs nothing and has the limits shown on our Pricing section. Paid plans are billed in advance, monthly or yearly, in US dollars, and renew automatically until cancelled.
- Prices exclude taxes such as GST, which are added where they apply.
- Payments are handled by our payment processor; we do not store full card numbers. Until online checkout is available, paid plans are arranged on request and invoiced.
- If a payment fails, we may move the workspace to the Free plan after telling you. Usage over a plan's limits (seats, published demos, AI credits, storage) is refused until you upgrade or the limit resets.
- We may change prices with at least 30 days' notice; the new price applies from your next renewal.
5. Cancellation and refunds
You can cancel anytime; your plan stays active until the end of the period you paid for and is not refunded. Details are in our Refunds and cancellations policy.
6. AI features
Paid plans include AI features (draft captions, chapter names, translation, generated voice and presenter videos). AI output can be wrong or unsuitable: review it before you publish. AI credits reset monthly and do not roll over.
7. The Free plan badge
Demos on the Free plan show a small TheTourKo badge and can be shared by embedding only. Removing, hiding or getting around the badge or plan limits is not allowed.
8. Availability and changes
We work to keep the Service available and secure, but provide it "as is" and "as available", without a promise that it will be uninterrupted or error-free. We may improve or change features; if a change takes away something material from a paid plan, we will tell you in advance and you may cancel.
9. Our property
The Service, its software, design and brand belong to us or our licensors. These terms do not give you rights in them beyond using the Service. Feedback you send us may be used freely to improve the Service.
10. Ending the agreement
- You can stop using the Service and ask us to delete your account at any time.
- We may suspend or end access for a serious or repeated breach of these terms, non-payment, or where the law requires it.
- When a workspace or organization is deleted, its content is hidden at once and permanently deleted after 30 days. Ask us before then if you need a copy.
11. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, revenue or data, and our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim (or INR 5,000 if you are on the Free plan). Nothing here limits liability that cannot be limited by law.
12. Indemnity
You will compensate us for claims by third parties arising from your content or your breach of these terms or the law.
13. Law and disputes
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the competent courts in India. Before going to court, please raise the issue with us so we can try to resolve it.
14. Changes to these terms
We may update these terms. We will post the new version here with its date and, for material changes, tell account owners by email at least 15 days before they take effect. Continuing to use the Service after that means you accept them.
